HYDROVA TERMS OF USE
These Terms of Use govern your access to and use of the Hydrova website, products, services, content, and related communications provided by Hydrova Motors (“Hydrova,” “we,” “us,” or “our”).
By accessing our website, purchasing a Hydrova product, or installing or using any Hydrova product, you agree to these Terms of Use.
If you do not agree to these Terms, please do not purchase, install, operate, or use Hydrova products.
Website Information
Hydrova makes reasonable efforts to provide accurate product descriptions, specifications, compatibility information, pricing, availability, photographs, and other website content.
However, product information may occasionally contain errors or may change as products are improved. Hydrova may update product specifications, designs, pricing, features, availability, or website content without prior notice.
Product photographs, renderings, videos, and illustrations are provided for general reference and may differ slightly from the final production product.
Prototype and Pre-Sale Products
Hydrova may occasionally offer prototype, pre-production, pre-sale, or newly developed products.
Specifications, appearance, materials, software, features, performance, packaging, and other characteristics of these products may change before final production.
Hydrova reserves the right to make engineering, design, software, and manufacturing improvements before final delivery.
Intellectual Property
All content on the Hydrova website, including text, graphics, photographs, videos, logos, product names, product designs, documentation, software, drawings, and other materials, is owned by or licensed to Hydrova and is protected by applicable intellectual property laws.
Hydrova content may not be copied, reproduced, distributed, modified, sold, published, or used for unauthorized commercial purposes without prior written permission.
Third-Party Brands and Compatibility References
Hydrova may reference third-party kayak, boat, accessory, or equipment brands solely to describe product compatibility or intended applications.
References to third-party brands do not imply sponsorship, endorsement, partnership, authorization, or affiliation unless expressly stated.
All third-party trademarks remain the property of their respective owners.
Vessel Registration and Legal Compliance
Motorized kayaks and small boats may be subject to registration, licensing, insurance, navigation, environmental, or boating requirements depending on the jurisdiction.
The customer is solely responsible for determining and complying with all laws and regulations applicable to the operation of their watercraft and Hydrova propulsion system.
Hydrova does not guarantee that installation of an electric motor is exempt from vessel registration, licensing, or other legal requirements.
SAFETY, RESPONSIBILITY AND ASSUMPTION OF RISK
Operating kayaks, small boats, electric propulsion systems, lithium batteries, GPS-controlled motors, remote-steering systems, and other watercraft equipment involves inherent risks that cannot be completely eliminated.
These risks may include, but are not limited to:
- Personal injury, serious injury, disability, or death;
- Loss of control of a kayak or watercraft;
- Capsizing, falling overboard, or immersion in water;
- Collision with boats, docks, swimmers, wildlife, structures, rocks, vegetation, or submerged objects;
- Propeller-related injury;
- Equipment malfunction or failure;
- Battery or electrical hazards;
- GPS, wireless control, remote steering, or position-hold interruption;
- Currents, tides, waves, wind, weather, poor visibility, and changing water conditions;
- Property damage; and
- Other known or unknown risks associated with boating and powered watercraft.
Some risks are unpredictable and may occur even when reasonable care is exercised.
Hydrova does not represent or guarantee that its products can be operated safely under every possible condition.
Assumption of Risk
By purchasing, installing, operating, possessing, lending, borrowing, or otherwise using a Hydrova product, you acknowledge and voluntarily assume the risks associated with electric propulsion systems and water-based recreational activities.
You are responsible for exercising reasonable judgment, evaluating water and weather conditions, using appropriate safety equipment, and operating the product responsibly.
User Responsibilities
You are responsible for:
- Reading and following all Hydrova instructions and safety warnings;
- Properly installing the motor, battery, adaptor, mount, remote, and related equipment;
- Confirming that all mounting hardware is secure before operation;
- Inspecting the product before each use;
- Maintaining the product in safe working condition;
- Using an appropriate personal flotation device where required or recommended;
- Maintaining awareness of swimmers, vessels, obstacles, and underwater hazards;
- Operating at a safe speed for the conditions;
- Properly storing, charging, transporting, and handling lithium batteries;
- Complying with applicable boating and navigation laws; and
- Making sure any person using your Hydrova product understands how to operate it safely.
GPS and Remote-Control Systems
GPS position hold, navigation assistance, remote steering, wireless controls, and similar electronic features are intended to assist the operator and do not replace responsible manual supervision.
GPS accuracy, wireless communication, positioning, and remote-control performance may be affected by environmental conditions, satellite availability, signal interference, battery condition, installation, weather, or other circumstances.
The operator must remain attentive and prepared to manually control or stop the watercraft whenever necessary.
Lithium Battery Safety
Lithium batteries must be used, charged, transported, and stored according to Hydrova instructions and applicable safety requirements.
Do not use or charge a battery that is swollen, punctured, leaking, unusually hot, physically damaged, or otherwise appears unsafe.
Do not disassemble, modify, puncture, crush, short-circuit, or expose Hydrova batteries to fire or excessive heat.
Insurance Notice
Insurance policies may not automatically provide coverage for motorized kayaks, electric propulsion systems, lithium batteries, boating accidents, or other activities involving Hydrova products.
Customers are encouraged to contact their insurance provider before operating a Hydrova product to determine whether their watercraft, equipment, personal liability, property, and other applicable risks are adequately insured.
Hydrova does not provide insurance and does not represent that any customer’s existing insurance policy will provide coverage for the use of Hydrova products.
Release of Claims
To the fullest extent permitted by applicable law, you accept responsibility for risks arising from the operation, installation, transportation, maintenance, storage, possession, or misuse of Hydrova products.
To the fullest extent permitted by law, you release Hydrova and its officers, employees, agents, distributors, dealers, contractors, service providers, and affiliated entities from claims arising from the inherent risks associated with water-based activities or your improper use of Hydrova products.
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable law.
Improper Use and Unauthorized Modification
Hydrova products should only be used for their intended purpose and within the specifications published for the applicable product.
Hydrova is not responsible for losses or damage resulting from:
- Improper installation;
- Incorrect wiring or voltage;
- Unauthorized product modification;
- Use of non-approved batteries or electrical components;
- Removal or modification of safety systems;
- Unauthorized repairs;
- Operation outside product specifications;
- Improper battery charging or storage; or
- Failure to follow instructions or safety warnings.
Limitation of Liability
To the maximum extent permitted by applicable law, Hydrova shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from the use or inability to use a Hydrova product or this website.
This may include, without limitation:
- Loss of use;
- Loss of fishing or recreational time;
- Travel expenses;
- Towing or transportation costs;
- Lost profits or business opportunities;
- Damage to other equipment; or
- Other indirect economic losses.
To the maximum extent permitted by applicable law, Hydrova’s total liability relating to a product shall not exceed the amount originally paid for that product.
Nothing in these Terms limits rights or remedies that cannot legally be excluded under applicable consumer protection laws.
Product Warranty
Any warranty applicable to Hydrova products is governed by the Hydrova Limited Warranty.
These Terms of Use do not expand or replace the coverage provided under that warranty.
Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Hydrova, its affiliated entities, officers, employees, agents, distributors, dealers, contractors, and service providers from claims, damages, liabilities, costs, and expenses arising from:
- Your misuse of Hydrova products;
- Your unauthorized modification of a Hydrova product;
- Your violation of these Terms;
- Your violation of boating, navigation, environmental, registration, or other applicable laws;
- Improper installation or maintenance; or
- Injury or damage caused by your negligent or unlawful operation of a Hydrova product.
User Photos, Videos and Reviews
If you voluntarily submit photographs, videos, reviews, testimonials, comments, or other content to Hydrova for promotional or marketing purposes, you represent that you have the necessary rights to provide that content.
Where permission is provided, Hydrova may use such content for marketing, advertising, educational, and promotional purposes.
Third-Party Websites
The Hydrova website may contain links to third-party websites or services.
Hydrova does not control and is not responsible for third-party websites, products, services, privacy practices, or content.
Privacy
Use of the Hydrova website is also subject to our Privacy Policy.

Consumer Rights
These Terms do not eliminate any mandatory rights available to consumers under applicable law.
Where provincial, state, federal, or other consumer protection legislation provides rights that cannot legally be waived or restricted, those rights will continue to apply.
Governing Law
These Terms shall be governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Mandatory consumer rights available in the customer’s jurisdiction remain unaffected where required by law.
Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
Changes to These Terms
Hydrova may update these Terms from time to time to reflect changes in products, services, business practices, or applicable requirements.
Updated Terms will be posted on the Hydrova website.
